These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Trucking Insurance Leads ("Trucking Insurance Leads," "we," "us," or "our"). These Terms govern your access to and use of the Trucking Insurance Leads website (www.truckinginsuranceleads.xyz), our software platform, 60-day renewal intelligence engine, daily lead feeds, and any related prospecting tools (collectively, the "Services").

BY CREATING AN ACCOUNT, SUBSCRIBING, OR OTHERWISE USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

You agree to provide accurate, current information when creating an account. Notify us immediately at support@truckinginsuranceleads.xyz if you suspect unauthorized access to or compromise of your account.

4. Subscription, Billing, and Cancellation

  • Annual Plan & Billing. The Services are provided on an annual subscription basis ($499 / year). Your subscription will automatically renew at the end of each annual billing cycle unless canceled prior to the renewal date.
  • Payment Processing. All payments are processed securely through Stripe. By subscribing, you authorize Trucking Insurance Leads (via Stripe) to charge your payment method on a recurring annual basis.
  • Cancellation. You may cancel your subscription renewal at any time directly through the Stripe Customer Portal in your Dashboard Billing tab, or by contacting support@truckinginsuranceleads.xyz. Cancellation will take effect at the conclusion of your current paid annual billing period.
  • No Refunds. All payments are non-refundable. You will retain full access through the end of the paid billing cycle, but no prorated or partial refunds will be issued for unused time.
  • Price Changes. We reserve the right to adjust subscription rates. Any price changes will be communicated in advance and will only apply to future renewal cycles.

5. Customer Data & Pipeline Information

As part of using the CRM pipeline, you may input, upload, or record notes regarding quotes, policy stages, and carrier contact attempts ("Customer Data"). You retain ownership of your Customer Data. You grant us a limited, non-exclusive license to host, store, and display your Customer Data solely to provide and operate the Services for your account.

You represent and warrant that your outreach to motor carriers complies with all applicable federal, state, and insurance licensing regulations, including telemarketing laws, CAN-SPAM, the TCPA, and state insurance producer guidelines.

6. Third-Party Integrations

The Services integrate with third-party providers including Stripe (payment handling), Clerk (authentication), and cloud infrastructure. We are not liable for the independent acts, omissions, or downtime of these third-party services.

7. Disclaimers & No Guarantee of Bound Policies

  • Trucking Insurance Leads provides commercial lead intelligence and CRM software tools. We do not guarantee any specific policy close rates, premium volumes, loss run approvals, or carrier underwriting acceptances. Binding commercial auto liability and cargo policies depends entirely upon your agency's appointed carriers, appetite, and execution.
  • Lead data is compiled from official federal filings (FMCSA/USDOT) and public transportation registries. While verified for high accuracy and updated daily, Trucking Insurance Leads makes no warranty that public records are free from typographical errors or carrier filings made after publication.

8. Acceptable Use

You agree not to:

  • Use the Services for unlawful marketing, harassment, or non-compliant automated dialing;
  • Reverse-engineer, decompile, copy, or redistribute the platform codebase or proprietary data feeds;
  • Deploy automated bots or scrapers to extract data outside standard browser and authorized export features; or
  • Share account logins across multiple unauthorized agencies to circumvent subscription licensing.

9. Disclaimers & Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKING INSURANCE LEADS WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF COMMISSIONS OR PROFITS. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU TO TRUCKING INSURANCE LEADS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be settled by binding individual arbitration rather than in court. You agree that any arbitration will be conducted only on an individual basis and waive any right to participate in a class-action lawsuit.
